Terms and Conditions of Use – EnayaUDH Telemedicine
By accessing and using the website or mobile application of EnayaUDH Telemedicine, you agree to be bound by the following Terms and Conditions, which govern the relationship between the user and the platform. These terms are compliant with the laws and regulations of the Kingdom of Saudi Arabia.
1. General Terms
- These terms supersede any prior agreements unless otherwise specified in writing.
- EnayaUDH reserves the right to modify or discontinue services at any time without prior notice. Continued use indicates acceptance of any changes.
- In the case of conflict between language versions, the Arabic version shall prevail.
- Failure to enforce any provision shall not constitute a waiver of future enforcement.
2. Eligibility for Use
- Users must be 18 years or older to use the services.
- Users agree to behave responsibly and refrain from illegal, offensive, or inappropriate use.
- Misuse or violation of the usage terms may result in immediate suspension or account termination.
- Sharing login information or attempting to access another user’s account is strictly prohibited.
- Users outside Saudi Arabia are responsible for compliance with their local laws.
- EnayaUDH reserves the right to suspend access for any misuse or breach of terms
3. Privacy and Data Protection
- User data is processed in accordance with SHIE and HIPAA standards.
- No sensitive medical data is stored on the website; all sensitive operations are managed via the mobile application.
- Some data may be stored or processed on servers outside the user’s region for technical reasons.
4. Intellectual Property
- All content, designs, software, and data belong to EnayaUDH or its technical partners.
- No part of the platform may be copied, modified, or redistributed without prior written approval.
5. Payment and refund
- Session prices are displayed within the app on each provider’s profile.
- Service providers have the right to update their prices at any time.
- Payments are made electronically through accepted gateways including: Mada, Visa, MasterCard, STC Pay, Apple Pay, Urway, Tabby.
- All prices are in Saudi Riyals (SAR).
6. Cancellation and Refund Policy
Full refund eligibility:
- If the cancellation is requested at least 6 hours prior to the scheduled session.
- If the provider fails to attend the session without prior notice or justification.
- If a technical failure in the application prevents the session from taking place.
- If the provider cancels and the client opts not to reschedule or use the amount in their wallet.
No refund situations:
- If the client ends the session during its course.
- If the session is completed in full.
- If the client misses the session without notifying or due cause.
In case of prepaid packages:
- If the client used one or more sessions from a multi-session package and then requests cancellation,
- Used sessions will be charged at full price (without any package discount),
- The remaining balance will be refunded.
Refund process:
- Refunds will be processed via the original payment method.
- Refunds to a bank account may take 21–30 business days.
- If a session fails due to a technical issue, a replacement session will be scheduled upon request.
7. User Obligations
- You must not use the platform to harm, harass, or annoy anyone.
- You shall not attempt to disrupt or damage the service or its functionality.
- You must maintain the confidentiality of your login credentials.
- You shall not resell or redistribute services without written consent.
8. Independence of Service Providers
- Medical providers on EnayaUDH are independent contractors, not employees.
- Any medical opinions or advice represent the provider’s individual judgment, not the official view of EnayaUDH.
9.Limitation of Liability
- All services are provided “as is” with no guarantees of specific outcomes.
- EnayaUDH is not liable for technical issues, data breaches due to user error, or reliance on provider advice.
- EnayaUDH is not responsible for harm resulting from sharing personal data with providers.
10. Security
- All data is encrypted using TLS 1.3 during transmission.
- Sensitive data is stored using AES-256 encryption.
- All platform activities are logged and audited per SHIE/HIPAA compliance.
11. Handling High-Risk Cases
In cases where a provider identifies a high-risk situation:
- Risk should be professionally assessed.
- The provider may attempt to contact a family member or emergency contact.
- If the case is severe, the provider is allowed to report it via the “Kolona Amn” app or by calling 911 / 999.
- For domestic violence or child abuse, contact the 1919 Family Protection Center.
12. Notifications
- EnayaUDH may send notifications via in-app alerts, emails, or SMS to the contact details you provided.
13. Governing Law and Dispute Resolution
- These terms are governed by the laws of the Kingdom of Saudi Arabia.
- Disputes shall be resolved via arbitration or competent courts unless settled informally.
14. Legal Remedies
- If you are dissatisfied with the platform or services, your sole remedy is to discontinue usage.
15. Support and Complaints
- Technical support is available via email or WhatsApp through the app.
- Complaints may be submitted through the app and will be handled confidentially and appropriately.
